1 Applicability

1.1 Applicability

These general terms and conditions apply to every offer from BooART Kunstbemiddeling VOF, hereinafter referred to as BooART, and to every distance agreement between you and BooART. Dutch law applies to these terms.

1.2 Changes

These general terms and conditions may be amended by us from time to time. If we amend these terms, we will always inform you.

2 Our product offerings

2.1 Limited validity

If an offer has a limited validity period or is made under specific conditions, we will always explicitly state this on our website www.booart.nl.

2.2 Price

All prices on our website include VAT and exclude handling and shipping costs, possible taxes or other charges, unless otherwise stated or explicitly agreed.

2.3 Obvious errors

We are not bound by obvious mistakes or obvious errors in the offer.

3 Your order

3.1 Agreement

The agreement between you and BooART is established after you have completed the order on the Website and received a confirmation email from us with the details of your order. Orders placed by persons under eighteen (18) years of age will not be processed.

3.3 Personal data

The personal data you provide to us will be processed carefully and in accordance with our privacy policy. Our privacy policy can be consulted via our privacy policy page.

3.4 Delivery

As a standard, we deliver orders within five (5) working days to the specified address, unless (i) another delivery date has been explicitly agreed, (ii) there is force majeure on BooART's side, (iii) the product is not in stock; and/or (iv) the order is non-standard. In the aforementioned cases, we deliver orders within 30 days after the agreement is established to the address you specified.

3.5 Delay

If the delivery is delayed – or can only be partially delivered – we will inform you as soon as possible (usually within 24 hours) and at the latest within a few days after the order date. You then have the right to dissolve the agreement free of charge.

3.6 Right of withdrawal

After receiving the product at the address you specified, you have fourteen (14) days to withdraw your order without giving reasons. If you have ordered multiple products simultaneously – and they do not arrive at the same time – the fourteen (14) day period starts from the moment the last product is received.

3.7 Payment

The amounts owed to BooART must be paid within fourteen (14) days after the start of the cooling-off period. Payment can be made via our payment methods.

3.8 Depreciation

If you handle the product in a manner that conflicts with the general terms and conditions, you are liable for the depreciation of the product resulting from this handling.

4 Returns

4.1 Notification

If you wish to exercise your right of withdrawal, you can do so by completing the model form and emailing it to info@booart.eu. As an alternative to the model form, you can also send an email stating your personal details, order date and invoice details. Upon receipt, we will send you a confirmation email.

4.2 Return shipping

As soon as possible, but within fourteen (14) days – after exercising your right of withdrawal – you must return the product to us.

4.3 Packaging

The product must be returned in its original packaging and in accordance with our instructions. You are responsible for any damage to the product during return shipping.

4.4 Burden of proof

As a consumer, you bear the burden of proof for the correct and timely exercise of your right of withdrawal.

4.5 Costs

The costs of returning the order are entirely at your expense.

4.6 Refund

Within fourteen (14) days after we have received the returned product, we will refund the full costs, including any delivery costs. Refund is made via the same payment method used during the order. If you have used a more expensive delivery method than standard delivery, we will not refund the additional costs of this delivery.

5 Questions or complaints

5.1 Description

If you have a complaint, you can direct it to our customer service via info@booart.eu. Please describe your complaint in detail so we can process it as effectively as possible. We will respond to your complaint within 5 days.

5.2 Disputes

If you are not satisfied after our handling of the complaint, you can submit the complaint to the European Commission's online dispute resolution platform at: https://webgate.ec.europa.eu/odr.
